He loves Super Mario Bros on his DS and I was thinking of finding him a similar not violent platform/puzzle game

Kirby Canvas Curse was pretty fun, drawing lines for Kirby to roll on rather than traditional platforming.

I second Yoshi's Island, lovely game.
I only ever got three for my DS, anyway - Geometry Wars, Yoshi's Island and a Pokemon game (I don't even remember which).

I have at least 50 games for my DS, I'm not sure which Mario game you have - but I'd recommend Mario Kart, New Super mario bros, Mario vs Donkey Kong 2, possibly the lego games (some of them can be a little glitchy). Warioware is really intense short mini-games, so depends what Jonathan likes.
Yoshis Island is good, makes good use of stylus, Starfox I would avoid, Zelda windwaker/spirit tracks might be a bit too advanced as would Metroid, Pokémon is probably as good an RPG as you will get (with mario/luigi partners in time) - but then again not everyone appreciates them as they are slow burn.
Tetris/Brain training - fun to an extent, but not really kid orientated, don't think Jonathan sounds like a nintendogs fan... GTA is definitely out of the question, advance wars probably is too, but there is certainly plenty out there. I enjoyed the pac-draw game myself.

He's got New Super Mario Bros and is very upset that New Super Mario Bros II doesmn't work on the DS

I know it's not a 3DS, but what DS is it he has? I'm asking as the original model and the DS Lite could accept GBA cartridges, so if he has one of those you could hit eBay for any of the Super Mario Advance titles for more Mario platforming goodness. The first SMB was also released for GBA as part of the Classic NES range.

I hate to say it - but new super mario bros II is awesome, as is Mario Kart 7. Lot of 3ds titles are shovelware though.
